PRICES:     

Our prices are quoted per piece, ex works Bechhofen. All offers are without obligation. The prices do not include any allowances regarding value dates or bonus or contributions to advertising costs and catalogs.

CONCLUSION OF CONTRACT:

Our quotations are always subject to change. We can accept our orders by sending an order confirmation or by shipping the ordered goods within the agreed term.

DELIVERY:

Deliveries are to be effected on the cheapest way of transportation. Additional costs for express or special delivery are to the buyer's expense. We reserve the right to make partial shipments and over- or under-shipments up to 10%. For offers and shipments we apply the Incoterms® rules of the International Chamber of Commerce (ICC).

ENTRY CERTIFICATE:

Our customer located in all European member states are obliged according to the German Tax Law to sign a Certification of Entry after receipt of the goods and to return the document to Zahn Pinsel GmbH. Please find here the corresponding form sheet.

DISPATCH & PACKAGING:

If not agreed otherwise the contracting party will be charged with the cost of packag-ing and transport. The brushes are sold in packing units as stated in our catalogue.

IMPRINT / LASER ENGRAVING:

Special imprints or laser engraving (name, logo, series no., barcode) are possible at a minimum order quantity of 120 pcs each item and will be charged at cost. Quantities below 120 pcs are only printed/lasered to the buyers expense. Additionally, one-time film cost of 30€ for 4 images will be charged if not agreed otherwise.

PAYMENT:

For the initial order we require payment in advance. Payments are to be made directly to us or to one of our bank accounts stated in the order confirmation.  We do not accept any bank or transfer charges. If PayPal payment is accepted, all fees are charged to the customer.

DELAY IN PAYMENT:

Defaults of payment (more than 30 days) are charged with current bank interest without notice. Reminders will be charged with 5,00 € each.

RESERVATION OF PROPRIETY RIGHTS:

The goods delivered remain our property until the complete amount is paid - also in case of processing and reselling.

COMPLAINTS:

Complaints can only be made within 8 days from receipt of goods. If justified we will replace worth of goods. Further claims for compensation cannot be accepted. Technical and material improvements as well as changes in colour of handles or minor discrepancies are subject to change. All shipments are in accordance with our General Terms and Conditions. Deviations Need to be confirmed in order to be effective. On day of publication all previous price lists and agreements become invalid.

DATA PROTECTION:

All personal data provided by the customer at the beginning of, or during the course of business dealings shall be processed and, in particular, stored in compliance with the provisions of the German Federal Data Protection Act (Bundesdatenschutzgesetz). The contracting partners are required to keep any information of their business, developed products and samples in secret if generally know or developed by a third party. All information are only to be used for the proper performance of the obligations arising from the contract. Protected information include technical data, images, drawings, calculations, order quantities, prices and information about products and current or future product developments, customer and supplier data as well as any company data of the contracting partner. Both parties are required to protect all data against unauthorized access, applying for electronic data, information on paper as well as samples.

LIMITED LIABILITY :

Our liability for damages - for whatever legal reason - is excluded, unless the claims are accepted under these conditions or on our part with written permission. We accept full liability in case of intent and gross negligence and liability under the Product Liability Act. We are liable in case of impossibility or culpable violation of a contractual obligation (cardinal obligation) that might prejudice the aim of the contractual scope. In these cases, the liability is limited to compensation for foreseeable loss or damage typically associated with the contract. This does not exceed in any case the triple value of the contract. Unless the contractor is entitled to claim under this provision, it expires at the end of the applicable statute of limitations for damages of 12 months. We reserve the right for technical improvements, material improvements as well as minor changes of handle colour and packaging.
